Although novelty helmets aren't legal in California, there are several states in these United States of America that they are. We are a nation of people whom are governed by a group of people who make up rules and regulations that they think the people should agree on and thus word the laws to read in such a way that they sound like reasonable requests, therefore the people vote these stupid laws in to effect and the majority of the people pay for them with their loss of rights provided them in the constitution.
The federal Department of Transportation (referred to hereafter as DOT) mandates that all motorcycle helmets in the U.S. be tested for safety. The DOT does its own in-house testing on these helmets, labeling those that meet its standards. That’s all fine and dandy, but why they are so concerned about ‘bikers safety’ in the first place, by taking our right to decide on our own, is beyond me. Other states, Wisconsin for instance, has instituted a law that protects your rights by mandating under the age of 21, must comply with helmet wearing laws, thus giving bikers over the age of 21 and no longer the responsibility of the parent, the right to wear one or not to wear one.
Novelty helmets aka skull caps, as most bikers call them, are a type of helmet that can protect the scalp against sunburn while riding and - if it stays on during a crash - might protect the scalp against abrasion, but it has no capability to protect the skull or brain. On the other hand, D.O.T. approved helmet aren’t as safe as the government would like you to think. Too many bikers have been permanently disabled due to the full face helmet that broke their neck due to its design and several bikers have crashed due to lack of visibility and sound. They literally couldn’t hear the truck coming.
Novelty Helmets are not to be confused with DOT helmets, thus the name NOVELTY. I don’t condone the use of novelty helmets, but I believe in freedom of choice.
